SAMSUNG GALAXY SPICA TERMS AND CONDITIONS
- The Samsung Galaxy SPICA Competition (‘the Competition’) is conducted by Samsung (‘the Organiser’) and is open to everyone living in S.A. except directors, members, agents, employees and immediate family members of any employees of the Organiser, its advertising agencies, advisors or suppliers.
- By entering the Competition, all participants and winners agree to be bound by these Terms and Conditions, which will be interpreted by the Organiser in its sole discretion, and its decision regarding any dispute will be final and binding. Any breach of the Terms and Conditions may, at Samsung's absolute discretion, result in forfeiture of any prize.
- By entering the Competition, you automatically become a member of the Samsung Fun Club if you are not already a member, and thereby receive communication from Samsung Mobile from which you may opt out or unsubscribe at any time. There are no costs, subscription or joining fees.
- The judge’s decision is final and no correspondence will be entered into.
- Only one entry per person over the Competition period will be allowed into the Grand Prize draw.
- Samsung accepts no responsibility for entries lost, misdirected, illegible, late, mutilated or altered.
- Entries that do not comply with these Terms and Conditions will be disqualified. Only the first valid referral will qualify as an entry.
- The Competition starts on 19 January 2010 and will close at midday on 01 March 2010.
- The prizes consists of the following:
• 3 (three) Samsung Galaxy SPICA phones will be given away every second week between the 19th January 2010 and the 01 March 2010.
• 1 (one) holiday to the Sossusvlei Desert for the final winner and 3 (three) friends for 5 (five) days to experience stargazing in the desert.
- Prizes are not transferable, and there is no cash alternative. The Organiser reserves the right to substitute a prize with any other prize of equal value to the prizes offered herein, at its sole discretion.
- Winners will be chosen via a random draw. The winners will be notified via email and/or telephone call on 01 March 2010.
- Samsung reserves the right to disqualify a winner if he/she does not respond to a telephone call and email to him/her within 24 hours of notification and randomly select by computer a replacement winner from the Competition entries. In such circumstances, the replacement winner shall be contacted by Samsung by telephone and email as soon as reasonably practicable and shall be required to respond to Samsung in the manner set out in such email. In the event that the replacement winner fails to respond to Samsung as required, then the provisions of this clause shall apply to that new winner in the same way as if he/she were an original winner.
- The winners hereby agrees to allow the Organiser, after obtaining the winners’ written permission, to require the winners (at no fee) to be identified and a photograph taken and published in printed media, or to appear on radio and television, when accepting their prize(s).
- Details of the winners may also be announced on the Samsung Fun Club website and any other media properties that it chooses. Samsung, acting reasonably, retain the right to delay the timing of the publication of the winners of the Competition.
- All participants and winners indemnify the Organiser, its advertising agencies, advisers, suppliers and nominated agents against any and all claims, damages or loss howsoever arising, including but not limited to wilful misconduct or negligent act or omission arising from their participation in the Competition.
- Samsung shall not be liable for any disruption to the Competition, whether due to technical problems or otherwise, which is beyond its reasonable control. In the event of any disruption to the Competition, the Organiser shall use its reasonable endeavours to remedy the disruption and resume the Competition on a fair and equitable basis to the entrants.
- The Organiser reserves the right to terminate the Competition at any time.
